LAST WILL AND TESTAMENT I, ELMER A. THOMPSON, also known as ELIC THOMPSON, residing in the state of Colorado, do hereby make, publish and declare this to be my last will and testament, hereby revoking all wills and codicils by me at any time heretofore made. FIRST: I direct that all my funeral expenses just debts be paid as soon as practicable after my death. SECOND: All the rest, residue and remainder of my estate, real, personal and mixed, of whatsoever kind and wheresoever situated, of which I may die seized or possessed, or over which I may have any power of appointment, I give, devise and bequeath to my wife, THELMA L. THOMPSON, absolutely, if she shall survive me and shall not die with me in a common accident, and such survival shall be for a period of not less than thirty days from date of my death, and if she shall not survive me or shall die with me in a common accident, then as follows: (a) one-half of my estate to my son JAMES, his issue or descendants, me surviving; (b) one-quarter of my estate to my son GERALD, his issue of descendants, me surviving; (c) one-eigth of myestate to my son RALPH his issue or descendants, me surviving; (d) one-eigth of my estate to my son DWIGHT, his issue or descendants, me surviving. THIRD: Whenever pursuant to the provisions of this will, all or any part of any devise and bequest shall be payable to a minor, title to the share of such minor shall pass to him, but payment of such share be deferred until attainment of twenty-one years of age, and in the meantime, such share shall be held by my trustee, who shall accumulate the income and apply all or such part of the income and corpus thereof as the trustee may determine to the support, maintance, benefit and education of such minor, and upon said minor's attaining the age of twenty-one, shall deliver the remaining corpus of such share, together with the accumulations, if any, of income thereof. FOURTH: I give and grant to my executor and trustee in addition to the usual powers of such office and not by way of limitation thereof the power to continue any and all investments constituting my estate, and to sell, transfer, convey, loan exchange, mortgage, lease or hold all or any part of the real, personal or mixed property of my estate. FIFTH: In the event of my death, I hereby nominate and appoint my wife THELMA the executor and trustee of this, my last will and testament, and in the event she shall die, resign, or be unwilling or unable to so serve, then I hereby name my son GERALD as such. I further direct that no party named herein shall be required to give bond or other security for the performance of duties. IN WITNESS WHEREOF, I have subscribed and sealed and do publish and declare these presents as and for my last will and testament, in the presence of the witnesses attesting the same, at my request, this 10 day of August, 1959. THOMPSON as and for his last will and testament, in the presance of us and each of us, who at his request, in his presence and in the presence of each other have hereunto subscribed our names as witnesses, this 10 day of August 1959.
